This website at 9am.dev is operated by METALOM LTD, a company registered in England and Wales under company number 16956239, trading as 9AM Studios. Our registered office is 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.

In these terms, “we”, “us” and “our” mean METALOM LTD. “You” means the person using this website.

This website uses the Tebex Headless API. The product listings, cart and prices you see here are presented by us, but the sale itself is completed by Tebex under Tebex’s terms and conditions, which you accept at checkout.

Because of this, anything to do with payment, invoicing, tax, refunds or payment disputes is governed by Tebex’s terms and not by these terms. Where these terms and Tebex’s terms conflict on any of those matters, Tebex’s terms apply. Our Refund Policy explains how this works in practice.

What we are responsible for is the software itself: its content, licensing and support. Your right to use anything you buy is set out in our End User Licence Agreement.

There are two different things called “signing in” on this website, and they are not the same:

• Signing in with FiveM at checkout. This is handled by Tebex and Cfx.re so your purchase can be linked to your Cfx.re account and delivered to it. We do not receive or store your Cfx.re password.
• Staff accounts on this website. These are used to administer the store and are created by us. Public registration is disabled — you cannot create an account yourself, and we do not offer one.

If you hold a staff account, you are responsible for keeping its credentials confidential and for activity carried out under it. Tell us promptly at support@9am.dev if you believe it has been compromised. We may suspend or close a staff account at any time.

You agree not to:

• Use the website unlawfully, fraudulently, or for any purpose that harms us or anyone else.
• Attempt to gain unauthorised access to the website, our servers, or any account that is not yours.
• Interfere with the normal operation of the website, including by scraping at a rate that degrades it, or by circumventing rate limits or security controls.
• Introduce malware or any other material that is malicious or technologically harmful.
• Copy, republish or resell any part of this website's content except as expressly permitted.

We may restrict or withdraw your access to the website if you breach this section.

We own or licence all intellectual property rights in this website and its content, including the 9AM Studios name, logo, page copy, images, documentation and the software we sell. Nothing on this website transfers those rights to you.

Buying a product gives you a licence to use that software on the terms in our End User Licence Agreement. It does not give you ownership of it.

We provide this website free of charge and do not guarantee it will always be available or uninterrupted. We may suspend, withdraw or change all or part of it without notice, for example for maintenance or because a third-party service it depends on is unavailable.

Product information, availability and pricing on this website is drawn from Tebex and may change. Where a listing is inaccurate, the details confirmed by Tebex at checkout are the ones that apply.

This website depends on services operated by others, including Tebex for commerce, Cfx.re for asset delivery and escrow, and analytics and email providers described in our Privacy Policy.

Where we link to third-party websites, we do so for information only. We do not control them and are not responsible for their content or their terms.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under the law of England and Wales.

If you are a consumer: nothing in these terms affects your statutory rights, including your rights under the Consumer Rights Act 2015 in relation to digital content that is faulty, not as described, or not fit for purpose. We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill, but we are not responsible for loss or damage that is not foreseeable.

If you are a business: we exclude all implied warranties and conditions to the fullest extent permitted by law, and we are not liable for loss of profit, loss of business, business interruption, or loss of anticipated savings. Our total liability to you in connection with the website and any product is limited to the amount you paid for the product in question.

We are not responsible for the operation, availability or decisions of Tebex or Cfx.re, or for loss arising from your server configuration, your hosting provider, or third-party resources you run alongside our software.

We may update these terms from time to time. The version published on this page is the one that applies, and the date at the top shows when it last changed. If we make a significant change we will take reasonable steps to highlight it.

These terms are governed by the law of England and Wales, and disputes will be dealt with by the courts of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom or in the European Union, you keep the benefit of any mandatory consumer protection rules of the country you live in, and you may be able to bring proceedings in your local courts.
